1.Deze algemene voorwaarden zijn van toepassing op alle diensten van ‘Xtra English4kids’ en op alle overeenkomsten die ‘Xtra English4kids’ sluit met ouders/verzorgers. De ouders/verzorgers accepteren de algemene voorwaarden door het schriftelijk afsluiten van een overeenkomst met ‘Xtra English4kids’.
These general terms and conditions apply to all services of ‘Xtra English4kids’ and to all contracts that ‘Xtra English4kids’ concludes with parents/guardians. The parents/guardians accept the general terms and conditions by making a written agreement with ‘Xtra English4kids’.
Afwijking van deze algemene voorwaarden is alleen geldig na schriftelijke bevestiging door ‘Xtra English4kids’.
Deviation from these general terms and conditions is valid only after written confirmation by “Xtra English4kids”.
Bij alle overeenkomsten die worden afgesloten met ‘Xtra English4kids’ zijn uitsluitend de algemene voorwaarden van ‘Xtra English4kids’ van toepassing.
All agreements made with ‘Xtra English4kids’ are exclusively subject to the terms and conditions of ‘Xtra English4kids’.
De leerling en ouders/verzorgers zijn verplicht alle gegevens en materialen die nodig zijn voor een correcte uitvoering van de diensten tijdig bij ‘Xtra English4kids’ aan te leveren.
For the correct implementation of the services, the pupil and parents/guardians are obliged to timely deliver all data and materials that are necessary to ‘Xtra English4kids.’
Alle overeenkomsten met ‘Xtra English4kids’ worden beheerst door Nederlands recht.
All contracts/agreements with ‘Xtra English4kids’ are governed by Dutch law.
Indien één of meerdere van de bepalingen in deze algemene voorwaarden nietig zijn of vernietigd mochten worden, blijven de overige bepalingen van deze algemene voorwaarden volledig van toepassing.
If one or more of the clauses of the terms and conditions are invalid or should be annulled , the remaining provisions of these terms and conditions remain fully applicable.
‘Xtra English4kids’ is gerechtigd deze Algemene Voorwaarden eenzijdig te wijzigen. Eventuele wijzigingen zullen per e-mail bekend worden gemaakt, minimaal 30 dagen voordat de wijzigingen in werking treden. De ouders/verzorgers zijn gerechtigd binnen deze 30 dagen schriftelijk kenbaar te maken dat zij het niet eens zijn met de wijziging, in welk geval de ouders/verzorgers het recht hebben de overeenkomst met ‘Xtra English4kids’ per direct op te zeggen. Eventuele reeds aan ‘Xtra English4kids’ verschuldigde en/of door ‘Xtra English4kids’ gefactureerde vergoedingen blijven verschuldigd en worden direct opeisbaar door ‘Xtra English4kids’.
‘Xtra English4kids’ is entitled to unilaterally change the Terms and Conditions. Any changes will be announced by e-mail, at least 30 days before the changes take effect. The parents/guardians are entitled to state in writing within these 30 days that they do not agree with the change, in which case the parents/guardians have the right to cancel the contract with ‘Xtra English4kids’ immediately. Any fees invoiced by ‘Xtra English4kids’ remain due and become immediately payable to ‘Xtra English4kids’.
Indien onduidelijkheid bestaat omtrent de uitleg van één of meerdere bepalingen van deze algemene voorwaarden, dan dient de uitleg plaats te vinden naar de geest van deze algemene voorwaarden.
If there is uncertainty about the interpretation of one or more clauses of the general terms and conditions, the interpretation must take place in the spirit of the general terms and conditions.
Bij zoekraken en/of beschadiging van materialen en/of hulpmiddelen door de leerling komen de kosten van reparatie of vervanging voor rekening van de ouders/verzorgers.
In the event of any loss or damage to materials and / or teaching aids caused by the pupil, the costs of repair or replacement will be borne by the parents / guardians.
‘Xtra English4kids’ is gesloten tijdens de officiële schoolvakanties voor het primair onderwijs regio ‘Zuid’ als vermeld op de website van de rijksoverheid. Let op : deze data verschillen per schooljaar.
‘Xtra English4kids’ is closed during the official school holidays for the primary education in the ’Zuid’ region, as stated on the website of the government. Please note: these dates differ per school-year.
Ouders/verzorgers worden minimaal 2 keer per jaar op de hoogte gebracht van de ontwikkeling/voortgang van de leerling.
Parents / guardians are, at least twice a year, informed about the progress of the pupil.
Van leerlingen en ouders/verzorgers wordt verwacht dat zij de actuele informatie betreffende hun schoolsituatie volledig en juist doorgeven.
Pupils and parents/guardians are expected to provide complete and accurate information about the school situation of their son/daughter.
Artikel 2. Definities

Aanmeldingsformulier : een door ouders/verzorgers ondertekende schriftelijke overeenkomst tot het verrichten van werkzaamheden en het afnemen van diensten.
Registration form: a written agreement/contract signed by parents/guardians for carrying out the work / and for the purchase of services.
Algemene voorwaarden: de algemene voorwaarden van ’Xtra English4kids’ zoals hier beschreven.
General conditions: the general conditions of ‘Xtra English4kids’ as described here.
Boeken : de gebruikte methode voor de cursus, tekst- en werkboek zijn verplicht om aan te schaffen door de ouders/verzorgers.
Books: the books used for the course, text and workbooks, are required to be purchased by the parents/guardians.
Cursusgeld : het bedrag dat verschuldigd is voor deelname aan de cursus.
Tuition Fee: the amount of money that is due for participation in the course.
Diensten : de dienst bestaat uit het geven van een cursus : ‘Xtra English4kids’: het is een naschoolse cursus voor de leerlingen van groep 4-8 om zich voor te bereiden op de middelbare school.
Services: the service consists of giving a course ‘Xtra English4kids. It is an after-school course for students in group 4-8 to prepare for secondary school.
Hulpmiddelen : alle tijdens de cursus gebruikte middelen ter ondersteuning en optimalisering van de werkzaamheden.
Resources: all resources used during the course to support and optimize the work.
Klager: een leerling van de cursus, ouders, verzorgers van deze leerling, alsmede anderen die een duurzame rechtsbetrekking hebben met de cursus.
Complainant: a pupil of the course, his/her parents, guardians, as well as others who have a sustainable legal connection with the course.
Leerling: degene die de cursus/lessen Engels volgt.
Pupil: the person doing the English course.
Les: tijdsbestek van 60 minuten, tenzij nadrukkelijk anders vermeld in de omschrijving van de cursus of schriftelijk anders is overeengekomen.
Lesson: duration of 60 minutes, unless explicitly stated otherwise in the description of the course or agreed otherwise in writing.
Lesmaterialen: boeken, dvd’s, cd’s, informatiedragers, werkbladen en spelmateriaal.
Teaching materials: text books, DVDs, CDs, media, worksheets and game material.
Locatie: adres waar de cursussen en de lessen worden gegeven.
Location: the address where the courses and classes are held.
Ouders/verzorgers: degene(n) die ‘Xtra English4kids’ opdracht geeft tot het verrichten van werkzaamheden met betrekking tot de cursus ‘XtraEnglish4kids’ of andere aan de Engelse taal gerelateerde activiteiten.
Parents/guardians: the person(s) who assign(s), course related work or other English language related activities to ‘Xtra English4kids’.
Overeenkomst : afspraken tussen ouders/verzorgers en ‘Xtra English4kids’ over wat ‘Xtra English4kids’ zal gaan doen of laten.
Contract: agreements between parents/guardians and ‘Xtra English4kids’ about what ‘Xtra English4kids will do or not do.
Overmacht: ziekte of verhuizing van de docent en het niet of niet tijdig nakomen door derden van de verplichtingen die deze jegens ’Xtra English4kids’ op zich heeft genomen.
Force majeure: illness or re-location of the teacher and non-compliance or late-compliance by third parties with the obligations that they have taken on ‘Xtra English4kids’.
Persoonlijke eigendommen: alle persoonlijke bezittingen die de leerling bij zich heeft tijdens de les.
Personal properties: all personal items that the pupil has with him during the lesson.
Xtra English4kids : ‘Xtra English4kids’ is de cursus Engels voor leerlingen van het basisonderwijs,Mev. Shabnam Hofland is de oprichtster en eigenaresse. De onderneming houdt zich bezig met het verzorgen van lessen, cursussen aan basisschoolleerlingen en andere personen op het gebied van de Engelse taal.
Xtra English4kids: ‘Xtra English4kids’ is the English course for primary school pupils, Mrs. Shabnam Hofland is the founder and owner. The company is engaged in teaching English to primary school pupils and other people in the field of English language.
Artikel 3. Betalingsvoorwaarden cursus
Het lesgeld voor de cursus Xtra English4kids bedraagt is € 16,- per les (exl. boekengeld). Het cursusgeld kan op de volgende manieren worden betaald :
□ in 6 termijnen van €105 ,-
□ in 2 termijnen : in juni € 315, en in december € 315,-
□ in 1 keer : € 630,-
Article 3. Payment terms
The tuition fee for the ‘Xtra English4kids’ course is € 16.00 per lesson (excluding books). The fee can be paid in the following ways:
□ in 6 instalments: € 105.-
□ in 2 instalments: € 315,- in June and € 315,- in December
□ single payment: € 630,-
Bij instroming in de cursus tussen de zomervakantie en de herfstvakantie dient het cursusgeld voor het hele cursusjaar te worden voldaan. Bij instroming na de herfstvakantie dienen alle resterende lesdagen te worden voldaan en een aantal lessen voor het inhalen van de lesstof, dit ter beoordeling door ‘Xtra English4kids’.
In the event of late enrolment into the course i.e. between the summer holiday and the winter holiday, the fee must be paid for the entire course year. Enrollment after the winter holiday, will cost the due payment for all the up-coming lessons, plus the number of extra lessons for a catch-up programme.

‘Xtra English4kids’ is gerechtigd het lesgeld in een keer te laten betalen.
‘Xtra English4kids’ is entitled to have the tuition fee paid in one go.
Lessen, die gemist zijn door de leerling, worden niet vergoed.
Lessons missed by the pupil will not be reimbursed.
Na het verstrijken van de betalingstermijn wordt een betalingsherinnering verstuurd per e-mail. Indien na 7 dagen nog geen betaling is ontvangen, volgt een tweede herinnering per post. In verband met administratiekosten wordt de factuur dan met 10% verhoogd. Tevens wordt de les voor de betreffende leerling of cursist stopgezet totdat de betaling is voldaan. Indien wederom geen betaling volgt na 7 dagen, wordt het factuurbedrag nogmaals verhoogd met 10%. Volgt op de derde herinnering geen betaling binnen 7 dagen, dan zal een incassobureau de zaak verder afhandelen. Alle bijkomende wettelijke kosten zijn dan voor rekening van de ouders/verzorgers.

De cursus ‘Xtra English4kids’ is officieel vrijgesteld van BTW.
The ‘Xtra English4kids’ course is officially exempt from VAT.
Artikel 4. Annulering / Opzegging door ouders/verzorgers

1.Tot zeven werkdagen voor aanvang van de cursus kunnen de ouders/verzorgers de inschrijving schriftelijk annuleren.
Up to seven working days before the start of the course, parents / guardians can annul the registration in writing.
Bij annulering binnen zeven werkdagen voor aanvang van de cursus zijn de ouders/verzorgers de betaling van 1 cursusmaand aan ‘Xtra English4kids’ verschuldigd. Het overige reeds betaalde cursusgeld wordt binnen vier weken na ontvangst van de benodigde gegevens terugbetaald.
In the event of annulment within seven working days before the start of the course, the parents/guardians are obliged to pay one month’s fee to ‘Xtra English4kids’. The remaining amount that has already been paid will be reimbursed within four weeks of receiving the required information.
Besluit een leerling voortijdig met de cursus te stoppen, dan geldt voor de ouders/verzorgers een opzegtermijn van 1 maand.
If a pupil decides to stop the course earlier, then the parents/guardians have a notice period of 1 month.
Opzegging dient schriftelijk te geschieden.
Annulment must be done in writing.

1.‘Xtra English4kids’ behoudt zich het recht voor een leerling te weigeren indien deze niet voldoet aan de door ‘Xtra English4kids’ gestelde toelatingseisen.
‘Xtra English4kids’ has the right to refuse a pupil if he or she does not meet the admission requirements set by ‘Xtra English4kids’.
De inschrijving vindt plaats op basis van volgorde van binnenkomst.
Registration takes place on the basis of the order of entry.
‘Xtra English4kids’ behoudt zich het recht voor een leerling zonder opgave van reden(en) te weigeren.
‘Xtra English4kids’ has the right to refuse admission to a pupil without giving any reason(s).
Artikel 7. Afzegging door ouders/verzorgers

1.Een leerling dient telefonisch of per e-mail te worden afgemeld. Leerlingen dienen door hun ouders/verzorgers te worden afgemeld.
A pupil’s leave from a lesson must be applied for, by the parents/guardians by phone or e-mail.

1.Bij afzegging door de docent, om welke reden dan ook, zal worden gezocht naar een passende vervanger of een ander tijdstip om de les in te halen.

Artikel 9. Annulering door ‘Xtra English4kids’

1 Bij onvoldoende aanmelding voor een cursus kan ‘Xtra English4kids’ de betreffende cursus annuleren. ‘Xtra English4kids’ zal de ouders/verzorgers hiervan tijdig op de hoogte stellen.
In case of insufficient admissions, ‘Xtra English4kids’ can cancel the course. ‘Xtra English4kids’ will inform the parents/guardians, timely.
Afgelasting van een cursus door ‘Xtra English4kids’ kan plaatsvinden het gehele cursusjaar. Het reeds betaalde cursusgeld wordt dan aan de ouders/verzorgers terugbetaald. De restitutie vindt plaats binnen vier weken na ontvangst van de benodigde gegevens van de cursist.
Annulment of the course by ‘Xtra English4kids may take place anytime during the whole academic year. The tuition fee paid in advance, is then duly reimbursed to the parents/ guardians. The refund takes place within four weeks of receiving the required information from the pupil.
‘Xtra English4kids’ kan het overeenkomst tussentijds beëindigen indien:
‘Xtra English4kids’ may prematurely terminate the contract, if:
– de leerling de afspraken regelmatig niet nakomt.
– the pupil regularly fails to meet the commitments.
– de leerling zich zodanig gedraagt dat effectief lesgeven hierdoor ernstig wordt bemoeilijkt.
– the pupil behaves in a way that effective teaching is seriously hindered.
– de leerling en/of ouders/verzorgers al dan niet opzettelijk verzuimt informatie met betrekking tot de cursus door te geven.
– the pupil and/or parents/guardians intentionally or unintentionally fail to provide information regarding the course.
– de ouders/verzorgers in gebreke blijft de lesgelden te voldoen.
– the parents/guardians fail to pay the tuition fees.

Herkenbare gemeenschappelijke waarden daarbij zijn: fysieke veiligheid, verantwoordelijkheid, vertrouwen en respect. Hiermee beogen wij het welzijn en de toekomstverwachting van de leerlingen te optimaliseren.

Wat is pesten? Onder pesten wordt verstaan: ‘Het langdurig uitoefenen van geestelijk en/of lichamelijk geweld door een persoon of een groep tegen een eenling die niet in staat is om zich te verdedigen’.

Nu kan je vaak denken dat is geen pesten, ze plagen elkaar maar wat. De ene keer doet de ene wat, de volgende keer doet de ander iets terug. Het is een spel. Plagen is lang niet altijd leuk, maar plagen is nooit bedreigend of grof. Maar wanneer het is geen plagen meer, heb je het over pesten.
You may often think that it is not bullying, they just tease each other. Sometimes one person does something, the next time the other gives something back. It is a game. Teasing is not always fun, but teasing is never threatening or rude. But when it is no longer teasing, it is bullying.
Wat doet ‘Xtra English4kids’ om pesten te voorkomen? Wij streven in alles naar een veilig lesklimaat, zowel voor medewerkers als voor leerlingen. Wanneer wij merken dat een kind gepest wordt, zijn twee dingen belangrijk. In de eerste plaats is het nodig dat er goed naar het kind geluisterd en op het kind gelet wordt. Voorts is het noodzakelijk, dat wanneer zich een pestsituatie voordoet, deze alleen kan stoppen als iedereen, d.w.z. ouder/kind/docent, samenwerkt. Daarom is het belangrijk dat uw zoon/dochter het vertelt als er iets is. Ook al heeft het zelf niks met de pestsituatie te maken.
What does ‘Xtra English4kids’ do to prevent bullying? We strive for a safe learning environment, both for employees and for pupils. When we notice that a child is being bullied, two things are important. In the first place, it is necessary that the child is carefully listened to and is watched over. Artikel 12. Schorsing/verwijdering.

Bij het voordoen van een ernstig incident, dat ingrijpende gevolgen heeft voor de veiligheid en/of de onderwijskundige voortgang van de cursus, kan worden overgegaan tot verwijdering. Ook wanneer een leerling onvoldoende inzet of motivatie toont, kan worden overgegaan tot verwijdering. Verwijdering van een leerling van cursus is een beslissing van ‘Xtra English4kids’.
If a serious incident occurs, which has major consequences for the safety and/or for the teaching-learning process of the course, suspension can take place. Even if a pupil shows insufficient commitment or motivation, removal can also take place. Removal of a pupil from the course is a decision of ‘Xtra English4kids’.
Artikel . 13. Aansprakelijkheid

1.‘Xtra English4kids’ aanvaardt geen enkele aansprakelijkheid voor diefstal, verlies of schade aan persoonlijke eigendommen van de leerling tijdens de aanwezigheid op de leslocatie, noch voor letsel aan de betreffende persoon.
‘Xtra English4kids’ accepts neither any liability for theft, loss or damage to the pupil’s personal property during his/her presence at the lesson location, nor for any injury to the concerned pupil.
De verplichtingen van ‘Xtra English4kids’ uit hoofde van de aangegane overeenkomsten zijn inspanningsverplichtingen. ‘Xtra English4kids’ is op geen enkele wijze aansprakelijk indien uw zoon/dochter de beoogde resultaten niet bereikt.
The obligations of ‘Xtra English4kids’, under the agreements, are those of best efforts. ‘Xtra English4kids’ is in no way liable if your son/daughter does not achieve the intended results.
‘Xtra English4kids’ is op geen enkele wijze aansprakelijk voor schade, van welke aard ook, die het gevolg is van (eventuele) foutieve of onvolledige informatie / aanbevelingen / adviezen verstrekt in verband met de cursus. Hieronder valt onder andere: de informatie / aanbevelingen / adviezen verstrekt door de docent enig ander werk voortvloeiend uit of verband houdend met een opleiding.
‘Xtra English4kids’ is in no way liable for damage, of whatever nature, that is the result of (if any) incorrect or incomplete information/recommendations/advice provided in connection with the course. This includes, among others: the information / recommendations / advice provided by the staff /any other work arising from or related to a study program.

1.Alle rechten van intellectuele eigendom op alle voor de overeenkomst ontwikkelde of ter beschikking gestelde documenten, software, alsmede al het materiaal dat hiermee samenhangt, berusten bij ‘Xtra English4kids’. De leerling verkrijgt uitsluitend de gebruiksrechten ten behoeve van de les/cursus en zal genoemde zaken niet verveelvoudigen, distribueren of kopiëren of op enigerlei andere wijze openbaar maken.
All intellectual property rights on all documents, software and all the related materials developed for the course or made available, belong to ‘XtraEnglish4kids’. The pupil only obtains the user rights for the lesson/course and will neither reproduce, distribute nor copy the items mentioned nor make them public in any other way.
Bij overtreding van Artikel 15.1 is de klant een gefixeerde boete van € 5000,- verschuldigd aan ‘Xtra English4kids’.

Artikel 16. Overmacht

1.In geval van overmacht worden de uit het contract voortvloeiende verplichtingen geheel of gedeeltelijk opgeschort voor de duur van zodanige overmacht, zonder dat ‘Xtra English4kids’ verplicht is tot enige schadevergoeding. In geval van overmacht zal de ouder/verzorger zo snel mogelijk worden geïnformeerd.

1.Mocht ‘Xtra English4kids’ volgens een leerling tekortschieten bij de ten uitvoerbrenging van de diensten, dan dient dit daags na de bijgewoonde les kenbaar te worden gemaakt, bij gebreke waarvan elke aansprakelijkheid jegens ‘Xtra English4kids’ vervalt.

Van de afhandeling van een schriftelijke klacht wordt de klager schriftelijk in kennis gesteld.
